Nakikita ni Senate Minority Leader Aquilino “Koko” Pimentel III ang isa pang batayan para kuwestiyunin ang 2024 national budget sa Korte Suprema. Sinabi niya na ₱450 bilyong dagdag na gawa ng bicameral conference committee sa mga hindi unprogrammed appropriations ay “unconstitutional.”
“Ang sabi ng Constitution natin, Congress may approve the appropriations proposed by the President for the operation of the government but it cannot increase the appropriations,” ayon kay Senate Minority Leader Aquilino “Koko” Pimentel III.
Tinutukoy niya ang Article 6, Section 25 ng 1987 Constitution, na nagsasaad, “The Congress may not increase the appropriations recommended by the President for the operation of the Government as specified in the budget. The form, content, and manner of preparation of the budget shall be prescribed by law.”
Sinabi ni Pimentel na ang National Expenditure Program mula sa ehekutibo ay naka-peg sa unprogrammed appropriations sa P281.9 bilyon lamang, ngunit ang bicameral committee, na nag-ayos ng mga pagkakaiba sa mga bersyon ng House at Senate ng panukalang batas, ay “bloated” ng halaga sa P731.4 bilyon.
Ang resulta ay halos ₱6 trilyon na budget, sa halip na ang orihinal na panukala na ₱5.768 trilyon lamang, ani Pimentel.
