Humiling ang kampo ni dating Pangulong Rodrigo Duterte sa Pre-Trial Chamber I na itama ang kanilang naging pasya sa indefinite adjournment request sa case proceedings ni Digong.
“In light of the patently detrimental effect of the above identified errors on Mr Duterte’s rights and on the fairness of proceedings, the Defence requests Pre-Trial Chamber I to certify the cited issues for appeal,” saad ng defense team ni dating Pangulong Rodrigo Duterte.
“The Pre-Trial Chamber erred in fact and in law when it ignored relevant clinical evidence on Mr Duterte’s cognitive condition, including that provided by the Defence experts,” saad ng defense team sa isinumite nilang dokumento sa Pre-Trial Chamber I na may petsang Pebrero 2, 2026.
Iginiit pa nila na nabigo ang Pre-Trial Chamber I na ibahagi nang maayos ang kanilang batayan kung bakit “fit to take part in pre-trial proceedings” si Digong.
“The Pre-Trial Chamber’s disregard of the divergent clinical opinions, and its finding of an absence of need to clarify contradictory medical findings, is a clear error,” mababasa sa dokumento.
Idinagdag pa nila na ang pagkakaroon ng immediate resolution hinggil sa isyu ay kinakailangan upang matiyak na uusad ang pre-trial proceedings ni Digong “on a sound basis, will avoid any future litigation on the matter, and will remove doubts as to the correctness of the Impugned Decision.”
