Pinaboran ng Supreme Court (SC) ang ipinagkaloob na amnesty kay dating Senador Antonio Trillanes IV na pinawalang bisa ni dating Pangulong Rodrigo Duterte noong nakaupo pa ito sa Malacanang.
“The Decision affirms that in balancing the exercise of presidential prerogatives and the protection of the citizens’ rights, the Constitution and the laws remain as the Court’s anchor and rudder,” ayon sa press release ng Supreme Court.
Iginiit ng SC na ang ginawa ni Duterte ay “unconstitutional.”
“The Court also grounded its ruling on the primacy of the Bill of Rights and reaffirmed that neither the Government nor any of its officials, including the President, are above the law,” giit ng SC sa press release nitong Miyerkules, Abril 3.
Ayon sa Kataas-taasang Hukuman, hindi maaaring bawiin ni Duterte ang amnesty na ipinagkaloob ng gobyerno kay Trillanes kung hindi ito aprubado ng Kongreso.
Noong 2018 nang kanselahin ni Duterte ang amnesty kay Trillanes sa pamamagitan ng pag-isyu ng Proclamation No. 572. Ito ay may kinalaman sa partisipasyon ni Trillanes sa failed Oakwood mutiny noong 2003 at failed Manila Peninsula siege noong 2007.
