Hindi sang-ayon si International Criminal Court (ICC) Pre-Trial Chamber I Judge María del Socorro Flores Liera sa kapwa niya mga hukom na nagdesisyon na ipagpaliban ang nakatakdang confirmation of charges hearing sa kaso ni dating Pangulong Rodrigo Duterte sa international court.
“Considering the Chamber’s duty to ensure the expeditiousness of the proceedings, the Chamber should have proceeded with addressing the Request by rejecting it, and continued with the pre-trial proceedings, including the holding of the confirmation of charges hearing,” giit ni Liera.
Kasunod ng pag-anunsyo ng Pre-Trial Chamber I ng ICC nitong Lunes, Setyembre 8, na hindi matutuloy ang confirmation of charges hearing sa Setyembre 23 ay inilabas din ang dissenting opinion ni Pre-Trial Chamber I Judge Flores na ipinapaliwanag kung bakit tutol siya sa naging desisyon ng Chamber na ipagpaliban ang naturang hearing.
Ipinaliwanag ni Flores na ang tanging layunin lamang umano ng confirmation of charges hearing ay timbangin kung sapat ang ebidensya na ipipresenta ng prosekusyon upang matukoy kung may “substantial grounds to believe that the person committed each of the crimes charged.”
Sinabi niya na hawak na umano ng Trial Chamber ang anumang assessment o katanungan hinggil sa kalusugan ng suspek, “under the Statute, matters of fitness and the assessment of the same are exclusively within the competence of the Trial Chamber.”
Iginiit niya rin ang mga probisyon sa article 61(7) ng Rome Statute kung saan nakasaad ang tatlong expected outcomes mula sa gagawing confirmation of charges hearing, na nagpapatunay sa kanyang argumento.
