Hinimok ng Office of the Public Counsel for Victims (OPCV) ng International Criminal Court (ICC) ang Pre-Trial Chamber I na tukuyin na “fit to participate in the proceedings” si dating Pangulong Rodrigo Duterte at magtalaga na ng petsa para sa confirmation of charges hearing ng kanyang kaso.
“The Legal Representative respectfully requests the Chamber to find that Mr Duterte is fit to participate in the proceedings and to set the date for the confirmation of charges hearing without further delay,” saad ni OPCV Principal Counsel Paolina Massidda.
Nagsumite ng mga obserbasyon ang OPCV sa ICC Pre-Trial Chamber I na may petsang Disyembre 18, 2025 hinggil sa joint at individual reports ng panel of medical experts na sumuri sa kalagayan ni Digong, kasunod ng pagsumite ng mga eksperto ng mga naturang report matapos suriin ang huli.
Iginiit ng OPCV na “fit to fully engage and participate in the pre-trial proceedings” ang dating pangulo dahil, anila, “the relevant legal criteria for Mr Duterte’s fitness to participate in the confirmation of charges hearing are fulfilled.”
“The Experts’ conclusions allow the Chamber to determine that the Suspect is fit to fully engage and participate in the pre-trial proceedings, including the confirmation of charges hearing pursuant to articles 61 and 64(2) of the Statute,” dagdag nila.
Sinabi rin nila na dapat nang isagawa ang confirmation of charges hearing sa kaso ni Digong sa ICC “in light of the Victims’ right to the expeditious conduct of the proceedings.”
