Inihayag ni Atty. Christian Monsod, isa sa mga bumalangkas ng 1987 Constitution, na kung sakaling ibaligtad ng Korte Suprema ang kanilang ruling sa impeachment complaint laban kay Vice President Sara Duterte ay maaari umanong gamitin ng Senado ang naunang desisyon ng Korte na kapag ang impeachment complaint ay “archived”, ito ay itinuturing nang “dismissed.”
“If you read the Supreme Court decision closely, it says that when it is archived, it is deemed dismissed… If the Supreme Court reverses itself, they (Senate) can invoke the Supreme Court ruling or decision that when the complaint was archived, it is deemed to be dismissed,” paliwanag ni Monsod.
“The point is this, I think people missed this, if you read the Supreme Court decision closely, it says that when it is archived, it is deemed dismissed right? If you read it, it’s there,” wika niya sa panayam sa kanya ni Christian Esguerra sa programang ‘Facts First’ noong Biyernes, Agosto 8.
“So this thing about archive and we will revive it and all that, I don’t know if that position will be different,” dagdag pa niya.
Kaugnay dito, sinabi ni Monsod na napansin niya umano sa mayorya ng mga senador na “they had the same mind, even as they were debating it” at “they were very happy…even with the word ‘archive’.”
“So I was thinking, I wonder why? Maybe somebody told them ‘don’t worry because archive is defined by…the Supreme Court that…according to the ruling of the Court, eh archived means dismissal’,” aniya.
