Nagsumite ng disqualification bid ang defense team ni dating Pangulong Rodrigo Duterte sa Appeals Chamber ng International Criminal Court (ICC) na humihiling na i-disqualify si ICC chief prosecutor Karim Khan mula sa kasong kinakaharap ni Digong sa international court.
“Chief Prosecutor Karim Khan…failed to disclose a grievous conflict of interest and must now, immediately and without delay, be disqualified from any further role in the case against Mr Rodrigo Roa Duterte,” giit ng defense team ni Duterte.
Sa 14-pahinang dokumento na may petsang Agosto 7, 2025, pinapa-disqualify ng defense panel si Khan sa kadahilanang “he failed to disclose a grievous conflict of interest.”
Sinabi nila na dati nang naging kinatawan si Khan ng mga biktima umano ng war on dr*gs campaign ni Duterte bilang “private lawyer” at ang nakuha niyang impormasyon mula sa mga biktima ay kanyang mistulang in-“exploit” matapos maging chief prosecutor ng ICC noong Hunyo 2021.
“In his subsequent role as Chief Prosecutor, Mr Khan seemingly exploited the information that he had acquired as a victims’ representative [REDACTED]. Mr Khan relied on information obtained while defending the independent interests of the victims to support actions falling under an entirely separate mandate — one that also carries the obligation to disclose exculpatory evidence,” mababasa sa dokumento.
Binanggit din nila ang mga alegasyong s3ksvwal na kinakaharap ni Khan, kaugnay sa kanyang ‘leave of absence’ at sinabing tumataliwas umano ito sa “presumption” ukol sa kanya na siya ay “of ‘high moral’ character and that his notifications should be taken as gospel.”
“Given the imminence of the confirmation of charges hearing, presently scheduled for September 23, 2025, the defense respectfully requests that the Appeals Chamber swiftly adjudicate this request to ensure that Mr. Khan is precluded from further participation in, and contamination of, the present case,” dagdag pa ng defense team.
