“Textual constitutionalists will often argue the very specific details of the Constitution however they fail to consider that not everything is… provided by the Constitution,” saad ni Tongol.
“There are things such as presidential immunity, or privilege presidential communication, that has not been provided specifically or expressly by the Constitution,” sabi ni Tongol sa isang episode ng “ABOGADO” na inilabas noong Huwebes, Hulyo 3.
Ito ay kaugnay sa idiniriin na argumento na ang nakasaad sa Konstitusyon ay “forthwith” o “immediately” ang pagsisimula sa impeachment trial.
Aniya, pati ang executive branch ng gobyerno ay may kapangyarihan umano na ma-interpret ang Konstitusyon katulad na lamang sa kaso ng ‘Manila Prince Hotel versus GSIS.’
“And the same way in exercising its duty, the Congress, whether it’s the House or the Senate, has also the power to interpret the Constitution on what it entails to try,” paliwanag ng Senate impeachment court spokesperson.
